7 DAYS EXCHANGE & REPLACEMENT POLICY STATEMENT
Goods sold are not refundable. Exchange is only accepted for merchandise with manufacturing defects and brought back within 7 days of purchase to the invoicing store. Merchandise must be brought back in original condition, unused with original packaging & sales receipt. Discounted items, promotional items and clearance items may not be exchanged. NO CASH WILL BE REFUNDED.
BEFORE DELIVERY:
NO CANCELLATION or REFUND is accepted for purchases made at Marc James Design. Alteration of specifications on items ordered and not yet delivered can ONLY be made within 3 days of purchase date. Marc James Design can accept no liability if goods are produced to a customer’s specification and that specification is subsequently found to be inappropriate.
AFTER DELIVERY:
For delivered items found with manufacturing defects, customers will have to request an inspector appointed by Marc James Design to perform an on-site physical inspection. The displayed item in our stores will be the benchmark for determining for quality (except for any variation in natural or raw material). To qualify for exchange, customers must report any defective items within 48 hours upon receipt of delivery.
GENERAL TERMS AND CONDITIONS:
- Please inspect all items before leaving our store; Marc James Design bears no responsibility for any damage after the customer leaves the store.
- No cancellation, exchange nor return will be accepted for tailor-made items, displayed items, defective items, discounted items, promotional items, breakable items & bedding accessories and item so specified on the sales receipt.
DELIVERY TERMS:
- Delivery service can be provided upon charges except on statutory holidays unless by prior arrangement. For details, please contact our sales representatives.
- Marc James Design shall use its reasonable endeavours to deliver products to customer delivery address but shall not be liable for any delays in its delivery services.
- The Customers should notify Delivery Department of a change in delivery address or deliver time at least 48 hours in advance.
- Customers should sign on the Delivery Note upon acceptance after delivery. Any damages after inspection and acknowledge of receipt by customers will not qualify for claiming return, exchange or replacement.
- Full payment must be settled in advance before any delivery. Marc James Design reserves all rights to withhold and / or forfeit products in case of dispute
- Our delivery service does not include removal or shifting of existing furniture or the removal of packaging without prior consent.
- Marc James Design does not deliver to properties without vehicular and lift access, otherwise, a walk-up charge of HK150 - per item of furniture or per load for non-furniture items will be added for every floor. We do not deliver above 3 floors (including ground floor) for properties without lifts. Marc James Design staff are not authorised to use lifting equipment of any description.
- Customers should ensure the delivery address reasonably allows the ordered item(s) to be delivered physically or is accessible and assembly possible thereat, otherwise an administrative or re-delivery charge of 30% on the item amount will be applied if an exchange is required. Marc James Design bears no responsibility for any such failure. Delivery charges on wasted trips(s) will not be refunded.
- If there is no one to receive the delivery an additional delivery fee will be charged for each subsequent delivery.
- Marc James Design bears no responsibility for any damage of items after it has been used, amended, adjusted, installed, assembled or subject to improper usage, and customers have signed for acceptance after delivery
- Customers should ensure safety of the premises or the delivery address to our staff and take care of their own furniture, interior decorations, flooring, wall and other properties during delivery. Marc James Design bears no responsibility for any additional expenses nor any damaged caused during such process.
- No Delivery service shall be available when typhoon signal No. 8 or above, or the black rainstorm signal is hoisted. If these signals are hoisted before the day of delivery, the delivery department will re-arrange the delivery date.
STORAGE CHARGE:
Marc James Design undertakes to store goods for a period of 30 days free of charge. However, beyond that period, an extra charge HK$200 per cubic metre per month will be charged. Should items be stored for over 90 days without any instruction from customers. Items will be forfeited accordingly Marc James Design reserves all rights upon dispute.
PROPERTY RISK:
All risk in the Products shall pass to the customer upon delivery to the customer’s delivery address or once the Product has been taken out of the shop, but Marc James Design shall retain the rights and interest in the Products until such time as full payment for the products has been effected.
LIABILITY:
- The liability of Marc James Design (to the extent permitted by law) whether in contract, tort or otherwise for any loss, damage or injury arising directly or indirectly from any defect in or non-compliance of the Products or any other breach of Marc James Design obligations hereunder shall not in any event exceed an amount equivalent to the price of the Products.
- Marc James Design shall not be liable for any consequential, indirect or special damage or loss of any kind whatsoever nor shall Marc James Design be liable for any damage or loss cause by the Customer’s servants. Delivery agents, buyers or other persons whatsoever.
- The Customer shall ensure that the products are not used for any purpose for which they are not suitable and shall be responsible for using all necessary skill and care in handling and using the Products. The Customer expressly acknowledges and agrees that Marc James Design assumes no liability for any advice or information given with the products and Marc James Design shall not be responsible for any inaccuracy or misstatement of any such information. The Products shall be accepted by the customer entirely at the Customer’s own risk.
FORCE MAJEURE:
If the performance by Marc James Design of its obligations is prevented by reason of “force majeure” (which shall include prevention occasioned by fire, casually, accident, and act of God, natural disaster, any law, order, proclamation. Regulation, demand or requirement of the Government of the Hong Kong Special Administrative Region or of any of its government agencies, strikes, labour disputes, shortage of labour or lack of skilled labour, shortage or unavailability of products or raw materials, delay in transit or other causes whatsoever (whether similar to the foregoing or not) beyond the reasonable control of Marc James Design, Marc James Design shall be excused from such performance to the extent of such prevention, and Marc James Design shall have no liability whatsoever towards the Customer.
Marc James Design reserves the right to alter these conditions of sales at any time and without prior notice.
In case of dispute; Marc James Design has the right to the final decision.
